BAY AREA BOTTOM TIMERS (BABT)

SINCE ACTIVITIES ON AND BELOW BODIES OF WATER BY NECESSITY INVOLVE SOME DEGREE OF DANGER, WE REQUIRE ALL PARTICIPANTS IN ACTIVITIES OF THE BAY AREA BOTTOM TIMERS (BABT) TO ASSUME ALL RISKS BY SIGNING THIS ASSUMPTION OF RISK AGREEMENT FOR RECREATIONAL DIVING.

I, (print name) _________________________, hereby voluntarily release, discharge, waive, and relinquish any and all actions or causes of action for personal injury, property damage or wrongful death occurring to me, which injury, property damage or wrongful death arises as a result of engaging in said diving activity, and/or underwater sport and any activities incidental to such activities, wherever, whenever or however such may occur.  I do for myself, my heirs, executors, administrators and assigns hereby release, waive a, discharge and relinquish any action or causes of action which may hereafter arise for myself and my estate and agree that under no circumstances will I or my heirs, executors, administrators, and/or assigns prosecute or present any claim for personal injury, property damage or wrongful death against the BAY AREA BOTTOM TIMER'S DIVE CLUB (BABT), its officers, directors, agents, or representatives for any of said causes of action, whether the same shall arise by the negligence of any said persona or organizations or otherwise.

It is my intention by signing this document, to exempt and relieve the organization named herein and its officers, directors, agents or representatives for personal injury, property damage or wrongful death caused by negligence or any other reason. By signing this document, I acknowledge that I assume the risk of personal injury, property damage ore wrongful death upon myself.

THE UNDERSIGNED, FOR MYSELF, MY HEIRS, EXECUTORS, ADMINISTRATORS OR ASSIGNS AGREES THAT IN THE EVENT OF ANY CLAIM FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH SHALL BE PROSECUTED AGAINST THE ORGANIZATION NAMED ABOVE, i SHALL INDEMNIFY AND HOLD THEM HARMLESS FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION BY WHOMEVER OR WHEREVER MADE OR PRESENTED FOR PERSONAL INJURIES, PROPERTY DAMAGE OR WRONGFUL DEATH.

I agree to furnish my own equipment and be responsible for its safety and good operating condition regardless of where I obtain it. I understand BAY AREA BOTTOM TIMERS (BABT) members may provide advice or assistance to me and agree to hold the BABT members harmless for any of their actions in attempting to be of assistance to me.

I have read, understand and agree to abide by the safety standards set for these recreational diving activities.  I understand and agree I am participating in these recreational diving activities voluntarily, and I agree to be responsible for my own actions.

I hereby declare that I am of Lawful age and legally competent to sign this Agreement, that I understand the terms herein are contractual and not a mere recital, and that I have signed this document of my own free will.  It is specifically agreed that if a person wishing to engage in BABT'S DIVE CLUB activities is under the age of majority for contract purposed, 18 years of age in California, his or her parent/legal-guardian signs below on behalf of such participant.

If any claim arises out of my participation in these activities, I agree the jurisdiction shall be the Superior Court of California, County of Alameda.

I ACKNOWLEDGE THAT I HAVE READ THE FOREGOING PARAGRAPHS AND FULLY UNDERSTAND THE LEGAL RIGHTS I AM GIVING UP BY SIGNING THIS DOCUMENT. THAT I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS AGREEMENT BY READING IT BEFORE SIGNING IT.
